❌ Myth: "If I have Power of Attorney, I can make all the funeral decisions for my loved one."

βœ… Fact: A Power of Attorney ends when someone dies.

This is one of the most common misunderstandings we hear.

A Lasting Power of Attorney (LPA) only gives someone authority to make decisions while the person is alive. Once they have passed away, the Power of Attorney automatically comes to an end and cannot be used to make funeral arrangements or decisions.

After a death, the person with the legal right to arrange the funeral is usually:

The executor named in the Will; or
If there is no Will, the next of kin or the person who will administer the estate.

That said, families often make funeral arrangements together, and the legal decision-maker will usually take into account the wishes of other family members and, most importantly, any known wishes of the person who has died.

At George Ball & Son, we understand that this can sometimes be confusing, particularly if someone held Power of Attorney for many years. We're here to explain the legal position clearly and help families work together to arrange a meaningful farewell.

Today, Robert Bush of Legacy Independent Funeral Directors was sentenced for crimes that have shocked the nation and caused unimaginable pain to hundreds of bereaved families. Our thoughts remain with every family affected by this heartbreaking case.

While one individual's actions should never define an entire profession, this case has exposed a significant issue that can no longer be ignored.

The funeral profession in England remains largely unregulated. At George Ball & Son, we have long supported the introduction of meaningful regulation, mandatory standards and greater accountability to help protect bereaved families and uphold the integrity of those funeral directors who provide the highest standards of care every day.

We are proud to be voluntary members of both the NAFD and SAIF, adhering to their Codes of Practice because we believe families deserve reassurance, professionalism and transparency.

A huge congratulations to Noah on graduating from The University of Nottingham last week – a fantastic achievement and the result of years of hard work, dedication and determination.
