These legal leaves exist so parents can be present for life's most important moments without unnecessarily sacrificing their employment. Knowing your rights helps protect your job, income, and dignity when your family needs you the most. Note also that employment status alone does not determine entitlement to these parental leave benefits. Each leave benefit (as of 2026) has its own eligibility requirements, including factors such as tenure, civil status, solo parent status, SSS qualification, or other conditions prescribed by law.
๐๐บ๐ฝ๐ผ๐ฟ๐๐ฎ๐ป๐ ๐๐ฒ๐ด๐ฎ๐น ๐ก๐ผ๐๐ฒ๐ & ๐ฆ๐ผ๐๐ฟ๐ฐ๐ฒ๐:
๐ Maternity Leave (RA 11210): Available to all female employees regardless of employment status or length of service. However, payment of the SSS maternity benefit remains subject to SSS eligibility requirements.
๐ Paternity Leave (RA 8187): Available only to legally married male employees who are cohabiting with their lawful wife, and only for the first four (4) deliveries, including miscarriages.
๐ Special Leave for Women (RA 9710): Requires at least six (6) months of aggregate service within the last twelve (12) months immediately before the gynecological surgery.
๐ Solo Parent Leave (RA 11861): Qualified solo parent employees are entitled to 7 working days of parental leave per year, provided they have rendered at least six (6) months of service (continuous or broken) with their employer.
๐ Lactation Break (RA 10028): Female employees are entitled to at least 40 minutes total of paid lactation breaks for every 8-hour working period. The law does not require this to be divided into two 20-minute breaks.
๐ADDING THIS: What about for miscarriage? An employee who experiences a miscarriage or emergency termination of pregnancy is entitled to 60 calendar days of maternity leave with full pay under the Expanded Maternity Leave Law or RA 11210. This also covers stillbirth. The leave must generally be taken continuously and cannot be postponed for later use.
The benefit applies to every instance of miscarriage, regardless of the employeeโs civil status, employment status, or frequency of pregnancy. Need to add this important detail!!! For private-sector employees, full pay normally consists of the SSS maternity benefit plus any required salary differential paid by the employer. SSS eligibility generally requires at least three monthly contributions within the prescribed 12-month period before the semester of miscarriage.
