BREAKING🚨 Ken Paxton JAILED a Houston midwife facing life in prison as Texas's first abortion-ban case — on the strength of one anonymous email, a court just ruled.
Maria Margarita Rojas, known to her patients as "Dr. Maria," was the first person in Texas charged under the state's near-total abortion ban, facing up to life in prison.
On Thursday, the Fifteenth Court of Appeals in Austin dismissed the injunction that forced her clinics to close, finding that Paxton's office relied solely on an anonymous email as evidence that she violated the 2022 ban. The court said the trial judge should never have leaned on affidavits from a parallel criminal case that didn't provide direct evidence any abortions happened. "The trial court abused its discretion in granting the temporary injunctive relief," Justice Scott Field wrote for a three-judge panel appointed by Greg Abbott.
Rojas ran three clinics that largely served low-income, uninsured, Spanish-speaking patients. One of them held a birthing center where she delivered babies. Paxton's office claims she employed unlicensed people posing as medical professionals, and it arrested eight of her workers last October.
Rojas was arrested in March 2025 and held in jail for 10 days until a $1.4 million bond was posted. She lost her livelihood and her midwifery license.
"The state of Texas has no case," said Jenna Hudson, senior counsel at the Center for Reproductive Rights. "Maria Rojas has been an upstanding midwife who delivered babies and provided lawful care for underserved pregnant patients."
Winning didn't give her the clinics back. Her attorneys say it will be nearly impossible to reopen them.
