My name is Tania Warner. I was incarcerated with my seven year old daughter by Customs and Border Patrol and ICE based on an illegal government policy.

That policy has since been overturned by a federal preliminary injunction on May 20, 2026 in Immigration Center for Women and Children v Noem.

The immigration judge is able to terminate my removal proceedings at any time, including based on this federal preliminary injunction. I am still being forced into removal proceedings even though they can be terminated based on this injunction. I thought it was supposed to be the worst of the worst.

As of May 20, the California District Court filed an injunction and it went federal. That means we are not deportable, yet we are still being forced through removal proceedings anyway. It is ridiculous, and I want my case terminated. That is the ultimate goal.

I want my due process returned to USCIS, and I want my daughter and I, both special needs, to be left alone. We have been through enough. Our lives should not be destroyed because of an administrative error in the government and an illegal policy that is causing us nothing but hardship.

Some days I can admit this out loud and some days I can’t. What my daughter and I have been through has been deeply traumatic, and we’re still putting the pieces back together.

And honestly I’m grateful there aren’t a bunch of news outlets asking for interviews right now. I know people are curious, but the quiet has been a gift. It’s given my daughter and I room to breathe, to regulate, and to start getting our life back together a little bit at a time.

I’m disgusted that our case wasn’t terminated when the reality is we are not deportable. I’m frustrated. I’m tired. And I’m honestly heartbroken that my daughter and I are being put through something that feels completely unnecessary.

They’re still pushing paperwork and extra steps even though my application still processes with USCIS. It feels like a waste of my time, a waste of taxpayer resources, and it’s destroying us financially.

But I’m taking this to the finish line no matter the outcome. Whether we stay or not, I will sue. That’s my right, and I’m not backing down.

Today’s court hearing did not go well but we are not backing down.

It’s getting crazy. We are being told there will be at least two more hearings after this before trial. We have done nothing wrong and we are going to keep showing up and fighting for what’s right for my daughter and I.

I won't lie, the nerves are real. But so is the determination. 🙏

They keep saying they don’t want immigrants “sponging off the system” but then they incarcerate mothers and kids while our honest paperwork is pending and taxpayers get the bill.

My daughter and I are being pushed through a profit driven detention pipeline for zero reason when we could be handled through USCIS like we are already trying to do the right way. Instead, they rack up costs, drag it out, and force families into impossible lawyer fees just to survive a system that should not be doing this in the first place.

We’re moving toward our first non-detained Master Calendar Hearing, and I’m asking for your support as my daughter and I keep pushing forward. We had a hearing in Dilley before our bond out hearing, and I’m learning firsthand how hard they make it to succeed.

I’m so grateful for all of you because without you, we wouldn’t have gotten this far. We would have been churned through this profit machine, had our lives turned upside down, and been spit out as refugees in a place we don’t call home anymore… with no belongings, and all of our animals left behind.

I just asked my daughter if she remembers two children from the five days we were in Ursula.
She looked at me… and she can’t remember them at all.

That’s not normal. That’s not “kids being kids.” And it’s not okay.

I’m worried about her, and I’m doing everything I can to keep it together for her—but I can’t afford the help she needs on my own. We’ve been told we need psychological assessments, and we’re also drowning in court costs: lawyer fees, filing fees, and travel expenses for hearings.
