California Upholds Judge's Ruling Banning Ma*****na Billboards; SAM Rejoices

(Alexandria, VA) - A California judge just affirmed a ruling from last week stating ma*****na companies in the state will no longer be able to advertise their products on billboards along interstate highways.

Given the overwhelming amount of research that finds that exposure to ma*****na advertising greatly increases the likelihood of youth ma*****na use, this should be considered a significant win for public health advocates, who have long fought to restrict advertising for addictive substances.

Dr. Kevin Sabet, president of Smart Approaches to Ma*****na (SAM) and a former senior drug policy advisor to the Obama Administration released the following statement praising the move:

"This one means a lot to us. W**d billboards have no place on our highway where they can influence minors.

"There is now an impressive body of research showing us that exposure to ma*****na advertising drives up youth use and acceptance of the drug. Given the many negative health outcomes that result from today's high potency THC, we cannot afford to allow the ma*****na industry to advertise their highly potent products.

"And this should only be seen as the beginning. We will keep fighting until the state restricts all ma*****na industry advertising altogether. The science cannot continue to be ignored."

CBD and the dangers.
More Cause for Concern about CBD: FDA’s Report to Congress
In a recent report delivered to Congress, the Food and Drug Administration (FDA) found the vast majority of CBD products the agency tested are mislabeled or adulterated, raising new red flags for consumers.

As part of the appropriations process, Congress directed the FDA to conduct a sample study of the current cannabidiol marketplace. Congress asked FDA to determine which products are labeled incorrectly or contaminated and to what extent. Agency staff tested and analyzed 147 products, including for their levels of THC– the chemical responsible for the psychoactive effects of ma*****na.

The findings reported by the FDA further illustrate the urgent need for regulation of these products.

In general, FDA’s review of CBD products has been limited and has not provided an accurate picture of the marketplace. To its credit, the FDA has sent dozens of warning letters to CBD manufacturers about making false claims and engaging in practices that violate existing regulations. And late last year, FDA confirmed that it cannot conclude that CBD is generally recognized as safe (GRAS) for use in human or animal food, a key designation for any product seeking FDA approval.

While we are encouraged by the steps the FDA has taken, much more needs to be done, especially in light of these recent FDA findings. The vast majority of CBD products available today do not comply with good manufacturing processes and are not scientifically tested to prove they have therapeutic value. This lack of compliance puts consumers at risk in a rapidly expanding CBD marketplace.

We continue to ask the FDA to go further in protecting consumers when it comes to CBD products.

Voters in Anchorage, Alaska Overwhelmingly Defeat Ma*****na Industry Push for "Pot Bars"

(Alexandria, Va) - In an election taking place last week, voters in Anchorage, Alaska overwhelmingly voted down a proposal that would have allowed for the on-site consumption of ma*****na. The proposal failed by a margin of 64% to 35%.

Dr. Kevin Sabet, president of Smart Approaches to Ma*****na (SAM) and a former senior drug policy advisor to the Obama Administration, released the following statement praising the results:

“People don’t want to expand the ma*****na industry. On-site ma*****na consumption has one of the biggest impacts on public safety of any policy shift and has been repeatedly rejected in many jurisdictions that have commercialized ma*****na. The impairing effects of ma*****na last beyond the sensation of being high. This proposal would have allowed pot shops to double as ma*****na 'bars' and greatly increase the risk of individuals consuming highly potent strains of ma*****na and then getting behind the wheel while impaired. We have seen drastic increases in drugged driving and ma*****na-related traffic fatalities in states that have legalized. More must be done to prevent this unfortunate trend, not encourage it.

“Furthermore, we cannot allow the ma*****na industry to trample laws put in place to limit the harms of secondhand smoke. In 2007, voters in Anchorage overwhelmingly approved a law to protect employees and the public from secondhand smoke and this was strengthened in 2013 to treat ma*****na smoke the same as to***co smoke. This proposal would have reversed these protections to bring back indoor smoking sections.

“The vote in opposition to this measure is encouraging and is only the latest in a string of setbacks for Big Pot. Across the nation, towns and municipalities are voting in support of measures restricting ma*****na industry operations. These local control measures include banning on-site consumption, banning sales, delivery, and even growing operations. We are happy to support these efforts and through our ‘Towns and Cities Initiative,’ we work to have staff and resources available to assist local communities protect their neighborhoods from Big Pot.”

Ma*****na News !

Dear Friend,

As if one needed another reason to stand against ma*****na commercialization, a recent study published in the journal Addiction builds upon the mountain of evidence that the reckless, drastic policy change results in negative outcomes for public health.

The study finds that ma*****na commercialization was associated with a 67-77% increase in ma*****na exposure calls to poison control centers, with a dramatic rise in exposures among those below the age of 21.

According to the study, had all 50 states and DC commercialized ma*****na in 2017, the total number of exposures nationwide would have risen by more than 60%.

Also according to the study, ma*****na commercialization increased the availability and accessibility of ma*****na among minors.

In its conclusion, the study’s author argues that more should be done to aid prevention efforts, with a specific focus on discouraging use of the drug among minors, and combat marketing of the drug.

The fact is, our nation is facing a multitude of issues that threaten public health...
..and with the potential for increased harms to public health and safety, whether it be dangerous exposure of highly potent ma*****na to minors, a continuation of the ma*****na va**ng crisis, or increased impaired traffic fatalities, the risks of expanding this industry are much too great.

Click the link below to send a message to your representative in Congress and urge them to oppose any and all efforts that would benefit the ma*****na industry at the expense of public health and safety.

Nothing can be more important than promoting the health and safety of our fellow Americans. Thank you for all that you are doing on that front.

Stay safe,

Dr. Kevin Sabet

About SAM

Smart Approaches to Ma*****na (SAM) is the nation's leading nonpartisan, non-profit public health alliance of concerned citizens and professionals who oppose ma*****na legalization and support science-backed ma*****na policies. SAM and its 30+ state affiliates have successfully prevented ma*****na legalization in dozens of state legislatures and at the ballot box.

Guided by a Scientific Advisory Board of scientists from Harvard, Princeton, and University of Colorado, SAM educates the public on cutting edge science: ma*****na is harmful, addictive, and legalization creates social injustice and expands illicit market activity.

Preventing Another Big To***co

03/14/2020

Facebook Join My List Logo
Dear Friend,

The ma*****na industry has taken the extraordinary step of exploiting the current COVID-19 crisis for its own ends. We felt compelled to set the record straight and, in cooperation with health authorities, release the following guidance on COVID-19 and ma*****na.

SAM STATEMENT ON COVID-19

COVID-19 has rapidly spread throughout the world and though there is some confusion about the details of the disease and its spread, one thing is certain: there are populations within the United States that are particularly vulnerable. Among these vulnerable populations, reports the National Institutes on Health and National Institute on Drug Abuse (NIDA), are individuals who smoke or v**e ma*****na, or have a history of smoking or va**ng ma*****na.

Underlying respiratory issues are a serious risk factor for negative outcomes from COVID-19. NIDA reports that "Because it attacks the lungs, the coronavirus that causes COVID-19 could be an especially serious threat to those who smoke to***co or ma*****na or who v**e:"

A report published by the Journal of the American Medical Association reviewed data from China and found that the case fatality rate for COVID-19 was 6.3 percent for people with chronic respiratory disease, compared with 2.3 percent overall (National Institute on Drug Abuse, 2020).
Deaths and serious illness from COVID-19 have been concentrated among vulnerable populations. NIDA reports, that it "is therefore reasonable to be concerned that compromised lung function or lung disease related to smoking history, such as chronic obstructive pulmonary disease (COPD), could put people at risk for serious complications of COVID-19."
NIDA also reports that va**ng can harm lung health just as smoking can, and as such, people who v**e can be exposed to increased risk from COVID-19.
In 2019, the country experienced a va**ng crisis in which as many as 2,739 people were hospitalized and 68 people died (Centers for Disease Control and Prevention, 2020). The more than 2,700 people who were hospitalized and suffer from residual complications associated with va**ng-related lung illness are at an increased risk of severe COVID-19.

NIDA concludes: "We can make educated guesses based on past experience that people with compromised health due to smoking or va**ng and people with opioid, methamphetamine, cannabis, and other substance use disorders could find themselves at increased risk of COVID-19 and its more serious complications-for multiple physiological and social/environmental reasons. The research community should thus be alert to associations between COVID-19 case severity/mortality and substance use, smoking or va**ng history, and smoking- or va**ng-related lung disease."

Unfortunately, the ma*****na industry has taken advantage of the situation. According to LegiStorm, "the first lobbyist to explicitly register on coronavirus-related issues is Jack Burkman - a right-wing trickster and conspiracy theorist...who has recently called for the president to ban coronavirus testing." Burkman is working on behalf of ma*****na industry executive Richard Goulding and registered effective Feb. 27 for work on unspecified coronavirus "issues" and "treatments."

Furthermore, the Federal Trade Commission warned "There currently are no vaccines, pills, potions, lotions, lozenges or other prescription or over-the-counter products available to treat/cure ( ). Coronavirus-related ad claims will be subject to exacting scrutiny." More on this can be found here: https://go.usa.gov/xdFCP

Stay safe,

H

Ma*****na Facts

1. WHAT DOES THE SCIENCE SAY ABOUT MA*****NA?
The dangers of ma*****na containing THC extend far beyond its role as an initiator for other drug abuse.

THE MOST SERIOUS DANGERS OF MA*****NA USE ARE BELOW:
1. Mental Health - There are serious effects of ma*****na use on mental health where it can trigger measurable psychotic symptoms in 40% of individuals with no family history of psychosis; and in regular recreational users, full-fledged chronic psychotic disorders at a greater rate than any other recreational drug, i.e. more than L*D, P*P, co***ne, methamphetamine, amphetamine or alcohol.

2. Cardiac Damage -There is an emerging literature on serious cardiac events being triggered by potent ma*****na use in the young, including some fatalities. Stroke, Arrhythmias, and cardiomyopathies are major outcomes of concern.

3. Risk of Cancer - Although the risk for lung cancer does not appear to be consistently increased by ma*****na use, three independent studies have shown that the risk for testicular cancer is doubled by regular use.
https://static1.squarespace.com/static/597f5bd2f7e0ab110dbfb2e5/t/5db712f032d2b013c84626d1/1572279031117/2.CIVEL.MA*****NA+AS+A+MEDICINE+-+POLICY%2C+SIDE+EFFECTS%2C+SPECIFIC+ILLNESSES.pdf

4. Use by Pregnant Women - Use by pregnant women of ma*****na to curb the nausea of morning sickness is a growing problem, particularly in light of the fact that no drug should be taken during pregnancy until proven safe. Colorado, which legalized possession of recreational ma*****na in 2012, is currently exhibiting a continued rise in birth defects.

5. Op**te use - Case control studies demonstrated ma*****na users are more likely, not less likely, to abuse op**tes. In point of fact, ma*****na use is not curbing the opioid epidemic in any state. It seems unlikely that ma*****na use will be effective in dealing with the op**te epidemic or in dealing with chronic non cancer pain.

6. Damage to children - Research shows that infants exposed to THC before birth suffer a wide array of neurocognitive and neurobehavioral deficits that cascade throughout childhood and adolescence, resulting in adverse social, health, educational and economic consequences. In the 2018 Arizona Child Fatality Review of the substance use related deaths, ma*****na was identified in 46% of deaths. The rate of ma*****na exposures among children under the age of six increased by 610% in the “medical” ma*****na states according to a study published in Clinical Pediatrics. The Surgeon General has stated: “We know that exposing the developing brain to ma*****na can prime the brain to addiction and have potential negative consequences including promoting cancer.”

7. Violence - According to research studies, ma*****na use is linked to aggressive behavior, causes or exacerbates psychosis and produces paranoias all of which lead to violence and homicide.

2. WHAT IS THE DIFFERENCE BETWEEN FDA APPROVED CANNABINOID-BASED MEDICINE AND STATE LEGISLATURE APPROVED CRUDE BOTANICAL “MEDICAL” MA*****NA?
FDA approved cannabinoid - based medicine has been proven to be safe and effective for certain medical conditions. State legislature approved crude botanical “medical ma*****na has not been proven to be safe and effective for any medical condition. The delta-9 tetrahydrocannabinol or THC in ma*****na causes the “high”. The ma*****na of today can reach 99% THC. These high potency products cause mental illness, violence, brain damage, school problems and a variety of health problems. Botanical crude ma*****na products approved by state legislatures pose many challenges including lot-to-lot consistency and variability to include that THC content can vary widely; is notoriously subject to contamination to fungus, microbes, toxic materials, heavy metals, and pesticides; warnings are absent or inadequate; people who use high potency ma*****na may get intoxicated and may hinder patients from obtaining more appropriate treatments.

3. WHAT IS BEHIND THE RISE IN THE ACCEPTANCE OF MA*****NA - SO CALLED MEDICAL USE, RECREATIONAL USE, AND FULL LEGALIZATION?

The “Big Ma*****na” industry includes businesses and lobbyists who put their financial gain over our health and safety. They include pro-ma*****na lobbying organizations, and those seemingly independent third parties, who spread false and deceptive statements about the risks of ma*****na. They have perpetrated a fraud upon the American people by these action.
1. False advertising by deceptively marketing “medical” ma*****na.
2. False statements concerning the safety of ma*****na.
3. Misbranding ma*****na as less addictive and less subject to abuse and diversion and less likely to cause tolerance and withdrawal than other medications.
4. Misrepresentation as to side effects and harms.
5. Misrepresentations as to the existence and frequency of occurrences, severity and extent of the overall risks of ma*****na use.
6 Misrepresentations as to the respective number of adverse events and deaths reported with the use of ma*****na.
7. Misrepresentations regarding the respective nature, seriousness, and severity of adverse events reported with the use of ma*****na.

4. WHY IS MA*****NA STILL A SCHEDULE 1 DRUG?
Based on the evaluation of the federal Department of Health and Human Services and the Food and Drug Administration and the Drug Enforcement Administration and all other relevant data, it has been concluded that there is no substantial evidence that ma*****na should be removed from schedule I. because:
(1) Ma*****na has a high potential for abuse. The HHS evaluation and the additional data gathered by DEA show that ma*****na has a high potential for abuse.
2) Ma*****na has no currently accepted medical use in treatment in the United States. Based on the established five-part test for making such determination, ma*****na has no “currently accepted medical use” because: As detailed in the HHS evaluation, the drug’s chemistry is not known and reproducible; there are no adequate safety studies; there are no adequate and well-controlled studies proving efficacy; the drug is not accepted by qualified experts; and the scientific evidence is not widely available.
(3) Ma*****na lacks accepted safety for use under medical supervision. The HHS evaluation states that ma*****na does not have a currently accepted medical use in treatment in the United States or a currently accepted medical use with severe restrictions. At this time, the known risks of ma*****na use have not been shown to be outweighed by specific benefits in well-controlled clinical trials that scientifically evaluate safety and efficacy.
