Can remote schedulers and virtual assistants be used by California home care agencies — and stay compliant? Short answer: maybe. It depends on access.
We’ve asked the HCSB directly: if a remote or third-party admin person touches client info or speaks with clients/prospects, they generally need a Guardian criminal background clearance — no matter where they’re located. That includes common roles like schedulers, intake staff, recruiters, payroll/bookkeeping, and customer service when those roles involve client contact or confidential data.
Key questions to ask before outsourcing:
1. Will they access client records or personnel files?
2. Will they call or message clients or caregivers?
3. Will they handle protected or confidential info?
4. Have they completed California Guardian clearance if required?
