⚠️ NDIS Reform Watch: Sector Concerns Continue

Recent reporting by The Guardian has highlighted serious concerns raised by the government’s own NDIS reform advisory committee about the proposed NDIS overhaul.

The report stated that the committee warned the changes could cause “material harm” to people with disability, undermine the original intent of the Scheme, and place significant decision-making power with the federal health minister.

The Australian Human Rights Commission has also reportedly raised concerns about the consultation timeframe and potential human rights impacts.

For NDIS providers, this is an important reminder that reform is not just a policy issue. It can directly affect:

• participant rights
• planning and support continuity
• evidence and documentation requirements
• provider communication
• choice and control
• governance and risk management

Whatever changes are ultimately introduced, providers need to stay informed, document carefully, communicate clearly with participants, and maintain strong safeguards around participant-centred practice.

🚨 NDIS Provider Governance Update

The NDIS Quality and Safeguards Commission has recently taken serious compliance action against a provider, including banning an individual from delivering NDIS supports and revoking a provider registration.

The matter reportedly involved serious and systemic breaches of the NDIS Code of Conduct, including concerns around:

• participant privacy
• respectful communication
• participant choice and control
• social media conduct
• provider governance and accountability

This is an important reminder for all NDIS providers: compliance is not just about paperwork.

Provider behaviour, director conduct, staff communication, participant rights, privacy, and online activity all form part of good governance.

At Clarity Connect Group, we support unregistered providers to strengthen their governance, compliance, via brokerage, auspice and operational frameworks so they can operate safely, professionally and in line with NDIS expectations.

With mandatory SIL registration commencing from 1 July 2026, now is the time for providers to review their systems, responsibilities and risk controls.

📢 Limited SIL Partnership Positions Available

Mandatory SIL registration begins from 1 July 2026.

The NDIS Quality and Safeguards Commission has confirmed that all providers delivering Supported Independent Living — SIL must be registered to do so, with a new SIL registration group 0138 created specifically for SIL providers.

Clarity Connect Group has SIL registration and is now considering very limited suitable SIL and shared living provider partnership arrangements.

Due to the compliance, governance and oversight required for SIL, we only have limited SIL partnership positions available.

This may suit providers who:

✅ Currently deliver SIL, shared living or 24/7 support
✅ Have participants requiring support for most or all of the day
✅ Have staff already in place or are building a reliable team
✅ Understand the importance of documentation and compliance
✅ Are willing to operate under a structured governance framework
✅ Want support through an auspice, brokerage and compliance partnership model

Before confirming suitability, Clarity Connect Group will need to review the participant’s support needs, roster model, worker documentation, risk profile, service agreement requirements and compliance expectations.

This is not a shortcut arrangement.
It is for suitable providers who are serious about safe, compliant and sustainable SIL service delivery.

SIL Registration Is Becoming Mandatory

Is your SIL service ready for 1 July 2026?

From 1 July 2026, all NDIS providers delivering Supported Independent Living — SIL must be registered with the NDIS Quality and Safeguards Commission under the new SIL registration group 0138.

If you are currently delivering SIL and are not registered, this change may affect your ability to continue providing SIL supports.

Clarity Connect Group works with providers as a registration access, auspice, governance and compliance partner, supporting providers operating under our compliance framework.

What does this mean for SIL providers?

SIL providers will need to ensure they are operating under the correct registration pathway and meeting the required compliance expectations before the mandatory registration changes take effect.

From 1 July 2026, SIL providers must comply with the new SIL Practice Standards, which focus on:

Participant rights, voice and choice
Safe and quality support in the participant’s home
Respecting participant freedoms
Clear governance and service delivery expectations
Compliance with NDIS quality and safeguarding requirements
What is SIL?

Supported Independent Living, or SIL, applies when a participant requires support for most or all of the day, and the provider manages and delivers supports that help the person:

Live as independently as possible in their home
Complete or be supervised with daily life tasks
Access their community
Receive home and living support in line with their support package
What is not SIL?

It is not SIL if:

A participant only receives a few hours of support each day or week
A participant chooses, directs, plans, rosters and manages their own support workers directly

Why act now?

From 1 October 2026, providing SIL without registration, or without having made an application for registration, may be a serious offence under the NDIS Act.

Providers who wait too long may face delays, compliance risks, or disruption to their ability to continue delivering SIL supports.
