Associated provider governance — what providers need to understand
If you engage associated providers to deliver services on behalf of your organisation — personal care workers, nursing agencies, allied health contractors — it is important to understand what the Aged Care Act 2024 requires of you in relation to those arrangements.
The registered provider cannot delegate its compliance obligations to an associated provider. That means:
✔️ SIRS assessment and notification remains the registered provider's responsibility, even where an incident occurs during an associated provider visit
✔️ Associated provider workers must meet the accepted worker screening requirements for risk-assessed roles
✔️ The registered provider must have oversight of the quality and safety of services delivered on its behalf
✔️ Services agreements with associated providers should reflect the obligations of the Aged Care Act 2024
Many providers are working from services agreements drafted before 1 November 2025 that do not reflect the current framework.
Reviewing and updating these agreements is an important step in strengthening your associated provider governance.
