Australian advertising safeguards

Under the National Law, advertising of a regulated health service must not be false, misleading or deceptive, use testimonials about clinical aspects of the service, create unreasonable expectations of beneficial treatment or encourage indiscriminate or unnecessary use of health services.

These general obligations are not limited to doctors. Ahpra states that advertisers can include registered health practitioners, individuals who are not registered practitioners, businesses, partnerships and corporate entities. (AHPRA)

Registered medical practitioners advertising cosmetic surgery are subject to an additional layer of cosmetic surgery-specific requirements designed to address risks particular to this type of healthcare advertising.

ASAPS is asking the government to examine whether Australian companies whose business model involves promoting and facilitating cosmetic surgery performed overseas are being captured by, and held to, an equivalent level of patient-safety protection.

Close the cosmetic tourism advertising gap: plastic surgeons call for government action after 60 Minutes investigation

The Australasian Society of Aesthetic Plastic Surgeons is calling on the federal government to address patient safety gaps as a growing number of Aussies undergo cosmetic surgery overseas at a lower cost. They're calling for a review of the regulations of Australian businesses which advertise, facilitate or sell overseas cosmetic surgery. President Dr Lily Verteck says it can be very risky.

"We're actually calling for the government to actually review the regulations of these businesses that advertise overseas cosmetic surgery because they're not subjected to the same regulations as the healthcare providers like the surgeons who do surgery in Australia. And also they need to educate. I think the federal government needs to put some money and put some effort into education.

Patients urged to prioritise qualifications, safety and long-term results over price

“I think we’re at an advantage in Australia in that we have a very tightly regulated cosmetic surgery sector,” he said.

Australia’s cosmetic surgery industry operates under strict standards covering surgeon qualifications, informed consent, advertising, patient assessment and follow-up care.
