Purchasing a plot only buys the interment rights (the legal permission to be buried in that designated space) rather than real estate. The cemetery organization retains title to the physical property.
According to the Bereavement Authority of Ontario, “Ontario law requires that every interment right be sold in perpetuity. This means you and your heirs will own the interment rights forever.”✅
Perpetual Care: A portion of the purchase fee (between 15-40% depending on the type of purchase such as grave, niche or crypt) goes into a mandatory trust fund to ensure permanent upkeep of the cemetery grounds. 🛠
Bylaw Compliance: All decisions regarding who can be buried and what headstones or markers are allowed must follow the specific cemetery's bylaws. 📑
Estate Asset: When an interment rights holder dies, the rights become part of their estate and pass to beneficiaries or next of kin, but they do not transfer automatically without updating registry records. ⚖
