CHC appeal deadlines — don't let time work against you

One of the most important practical aspects of the CHC appeal process is timing. Missing a deadline doesn't automatically end your appeal — but it can weaken your position and complicate the process significantly.

Key timeframes to be aware of:

→ Requesting the DST: There is no strict statutory deadline, but the sooner you request it, the sooner you can assess your grounds. Write immediately after receiving the decision.

→ Raising a local resolution challenge: There is no nationally mandated deadline for initiating local resolution, but ICBs may have their own policies. Delays can be used against you. Act promptly — within weeks of the decision, not months.

→ Escalating to NHS review: If local resolution does not resolve the matter, escalation to NHS review should be requested promptly. ICBs have 12 weeks to complete a review once requested.

→ Requesting an Independent Review Panel: A request for an IRP must be made within 6 months of the ICB's review decision. This is a firm deadline.

→ Retrospective reviews: If funding was previously withdrawn and you are looking at a retrospective challenge, the IRP has discretion over whether to consider cases where significant time has passed. Earlier action is always stronger.

This guide exists because of one specific experience

My mother has been tetraplegic for many years. Multiple strokes. Complex, high-level care needs that have not materially changed over time.

After two years of NHS Continuing Healthcare funding, the ICB conducted a review and concluded that she no longer met the threshold for primary health need.

Nothing had changed in her condition. What had changed was the way her needs were being assessed and recorded.

I spent months learning the CHC framework. Reading the National Framework and the statutory guidance. Examining the DST line by line. Using AI tools to help analyse what was recorded against what I knew to be true. Building an evidence base. Writing the challenge letters.

I'm not a lawyer or a healthcare professional. I'm a family member who had to figure this out under pressure, at a time when there were many other things demanding my attention.

The CHC Appeal Guide is what I wish had existed at the start of that process. It doesn't make it easy — this is an inherently difficult thing. But it makes it less bewildering. And for families who are prepared to engage with the process seriously, it gives them the best possible foundation for doing so.

The Mobility domain — beyond basic movement

The Mobility domain covers needs arising from impaired ability to move — including the level of assistance, equipment, and clinical input required to manage mobility safely.

A common assumption is that this domain is about whether someone can walk. In practice, it covers a much wider range of needs — and for many care home residents, it is a domain where the scoring significantly underrepresents the real level of need.

For a higher rating, the relevant considerations are:

→ Does the person require specialist manual handling techniques or equipment — including profiling beds, specialist hoists, or complex positioning regimes? → Is the mobility impairment associated with a significant and ongoing risk of falls, injury, or pressure damage? → Does managing mobility safely require trained input — not just assistance, but the application of clinical knowledge? → Does the complexity of the mobility need affect other domains — for example, contributing to skin breakdown, continence difficulties, or nutritional risk?

The last point matters: mobility needs that contribute to or complicate other clinical needs may strengthen the case for a higher rating across multiple domains simultaneously — which is relevant to the overall primary health need threshold.

What I would tell someone at the very beginning

If I could go back and give myself one piece of advice at the start of the process, it would be this:

Request the Decision Support Tool immediately.

Not in a few weeks. Not after you've decided whether to appeal. Immediately — in writing, to the ICB.

The DST is the document that shows you exactly how the assessment was scored and why. It is the foundation of any challenge. And the sooner you have it, the sooner you can make an informed decision about your grounds.

The second thing I'd say: start keeping a care diary now, even if you haven't formally decided to appeal.

The most powerful evidence in a CHC appeal is specific, contemporaneous documentation of care needs. If you start recording now — dates, times, what happened, what care was required, what would have happened without that care — you will have something concrete to work with. Trying to reconstruct this retrospectively is much harder.

Both of these actions cost nothing and commit you to nothing. They simply put you in a stronger position if you do decide to go forward.

The Psychological & Emotional Needs domain

The Psychological & Emotional domain covers needs arising from mental health conditions, emotional distress, and the level of clinical or specialist input required to manage them safely.

This domain is often misunderstood. It is not asking whether the person is sad, anxious, or distressed — it is asking whether those psychological and emotional needs require a level of skilled response that goes beyond standard social care.

For a higher rating, assessors are looking at:

→ Whether there is a diagnosed mental health condition requiring ongoing clinical management → Whether the person is at risk of self-harm and requires skilled monitoring and intervention → Whether managing psychological needs requires input from a specialist mental health professional → Whether the distress the person experiences is severe, unpredictable, and affects their physical health and safety

The distinction between social and health need is particularly contested in this domain. A person experiencing severe anxiety or depression in the context of a life-limiting physical condition — where that distress affects their ability to comply with medical treatment, creates clinical risk, or requires specialist psychological input — may have needs that support a higher rating than a simple "Moderate" would suggest.

Evidence from psychiatric consultants, community mental health teams, or specialist nurses is valuable in this domain.

Understanding the role of the ICB in CHC decisions

Since July 2022, NHS Integrated Care Boards (ICBs) replaced Clinical Commissioning Groups (CCGs) as the bodies responsible for CHC commissioning and decision-making in England.

If you're navigating a CHC appeal, the ICB is the organisation you will be corresponding with at local resolution and NHS review stages.

A few practical points worth knowing:

→ ICBs vary considerably in how they manage the CHC appeal process. Some are more responsive than others. Don't assume that a lack of response means agreement — follow up in writing and keep records of all correspondence.

→ The ICB has a formal duty to follow the National Framework for NHS Continuing Healthcare. If you believe the process has not been followed correctly — wrong composition of the MDT, inadequate notice of the assessment, failure to provide written reasons — this is a legitimate ground of challenge.

→ You can request a copy of the ICB's CHC policy. Some ICBs have local operating procedures that supplement the National Framework. Knowing these can be useful.

→ If you have exhausted the formal appeal process and still believe the decision is wrong, the Parliamentary and Health Service Ombudsman (PHSO) is the body that handles complaints about NHS organisations.

The Altered States of Consciousness domain — what it covers

The Altered States of Consciousness domain covers needs arising from episodes of altered consciousness — including epileptic seizures, blackouts, and other conditions where loss or impairment of consciousness creates clinical risk.

For families caring for someone with epilepsy, this domain is often central to the overall case.

A person who has frequent, unpredictable seizures — particularly where those seizures require skilled intervention (rescue medication, positioning, post-ictal monitoring) and where there is a risk of serious harm if the response is delayed or inadequate — may have needs that support a High or Severe rating in this domain.

The key factors are: → Frequency and predictability of episodes → Whether rescue medication is required and must be administered by a trained person → The risk to the person during and after an episode → Whether the management of the condition requires qualified nursing or clinical oversight

For this domain in particular, the incident log tool included in the CHC Appeal Guide is valuable — because documented evidence of seizure frequency, duration, severity, and the response required is far more persuasive than a general description.
