What is a Special Guardianship Order?

A special guardianship order provides a child with a long-term home under a special guardian, giving them enhanced parental responsibility while maintaining the child’s legal ties to their birth parents.

A special guardianship order (SGO) is a court order that appoints an individual, usually a relative or close family friend, as a child’s special guardian until the child turns 18, unless the court decides otherwise (Children Act 1989).

Unlike adoption, the child remains legally part of their birth family, but the special guardian gains enhanced parental responsibility, allowing them to make most day-to-day decisions about the child’s upbringing, including schooling, medical care, and general welfare, without needing to consult the birth parents.
