A senior therapist in Hampshire has just won over £32,000 at tribunal after being left out of a restructure.
She’d been dealing with severe perimenopause symptoms since 2022 - migraines, hot flushes, recurrent UTIs. When her employer restructured, most of the team were offered new roles under the new business name. She wasn’t one of them.
The tribunal found disability discrimination, failure to make reasonable adjustments, victimisation, and wrongful dismissal.
You’d think a predominantly female industry like beauty and wellness would have this figured out by now. Apparently not.
This case is a reminder that menopause can legally count as a disability under the Equality Act 2010. That means reasonable adjustments aren’t a nice-to-have, they’re a legal duty.
And a restructure doesn’t wipe the slate clean. If the people who get left behind are the ones who’d raised health issues, that’s still a problem - whatever you call the reshuffle.
If you’re an employer and you’re not 100% sure your managers would handle this well, we can help. Menopause awareness training gives your team the confidence to support staff properly - and protects your business too.
