Reg: Pension Updation taken up with DFS, & other matters

Friends,

You must all be quite eager to understand what exactly is happening to our major issues concerning, Up-gradation of Pension, Improvement in Family Pension, Age limit for full pension to 67, etc. Here is a communication received from Sri Agnihotri , the Brain-Trust in AIRIEF, with whom we have been functioning in close coordination. This should give you an idea of how things are moving. Sri Anand Tyagi, from Lucknow, is the leader of the Retired Development Officers, and was their All India President in the days I was in Lucknow in the serving days. He has been extremely active in trying to reach the Govt. channels through his sources of influence. In fact, during our last Delhi visit in early 2020, for the SC Hearing which got adjourned, we met the Additional Secretary of Finance, Smt Daksh*ta Das, along with a Delegation that included Sri Anand Tyagi. It is that name of Sri Anand Tyagi, which has found mention in Sri Agnihotri's message, as narrated below

1. "As you are aware, Smt. Ranjanben Bhatt, Member of Parliament from Vadodara has taken up our pension related issues with the Finance Minister vide her letter dated 12/09/2020. She also had a meeting with the Finance Minister wherein the officials of Department of Financial services were present, to resolve the issues. This initiative was taken by Shri Anand Tyagi.

2. Subsequently, Shri Anand Tyagi met the officials of DFS on 23/11/2020 to follow up our issues. He informed that most of the officials in DFS (Insurance) were changed. New Additional Secretary now is Shri Ajay Agarwal and new Joint Secretary is Shri Sudhir Shyam. Shri Tyagi gave reference of our representation submitted to the Finance Minister through Madam Ranjanben Bhatt, MP and her meeting with the FM. The new team called for the details of meeting and the instructions of the Finance Minister, which were presented by the concerning lady officer. It was also informed that matter is referred to Law Ministry on certain issues. Shri Tyagi presented the issues systematically before the Joint Secretary. He gave a patient hearing and told that he has recently joined and not aware of the issues but he will do his best to resolve the issues. During the course of discussion, the matter of updation was discussed specifically on the basis of the notes submitted by us (appended herewith). The Joint Secretary advised Shri Tyagi that being the Sr. Citizen, he need not come to DFS and the information will be given to him by the Department.

3. Shri Anand Tyagi also had a talk with the Chairman on 29/11/2020, informed him about the meeting with DFS officials and requested for effective follow up with DFS. The Chairman informed that he was aware of the meeting and assured for following up the matter with DFS from his side.

4. On 30/11/2020, Shri Tyagi got information from DFS that file has come back from Law Ministry with their approval on certain issues (reportedly family pension and increase in age from 65 to 67 for full Family Pension) and further action is under consideration of the department.

5. In the meantime, our representation on our main issues were submitted to the FM through Shri Prahlad Joshi, Minister of Parliamentary Affairs, through the instrumentalities of Dharwad and also to Shri Rajnath Singh, Defence Minister, through the instrumentalities of Lucknow, so that our case gets due importance. All these activities were initiated and monitored by Shri Tyagi in consultation with the leaders of joint front of the Pensioners Unions.

6. Friends, I am happy to inform that Madam Ranjanben Bhatt, Hon'ble MP, Vadodara has reminded Hon'ble Finance Minister vide her letter dated 10/12/2020 to grant relief to LIC Pensioners at the earliest (Letter attached). Shri Tyagi ji informed that she has also had a talk with Hon'ble Finance Minister and Hon'ble MoS and requested for early action in the matter.

7. During this hard time of COVID -19 PANDEMIC, we are trying to take up our issues at all appropriate levels, following up and requesting for a prompt action through whatever channels are available. Shri Anand Tyagi ji is doing a great job by using his contacts and personally involving in the activities being undertaken. We do not know to what extent we would be successful; but we are sharing the steps being taken up for redressal of our issues.

There is hope for updation of Pension of Bank retirees as the matter was brought to the notice of Prime Minister personally by a leader close to him.

An eye opener for all the LIC RETIREES ASSOCIATIONS who had filed fresh writs after 2016 SC judgement.
I had been requesting, suggesting and submitting all the retirees and leaders of the Federations to approach the PM as the solution of Revision /updation lies only with the GOI, but they preferred only legal course even when SC on 31.3.2016 had clearly said that unless rules are amended by Parliament revision of pension cannot take place. PM also had written same thing twice to me on my representations to PM.
Thus issue is in the hands of PM/ GOI.

Wish all good health and happiness, with the hope that Bank retirees get early relief on revision of pension and thereafter Insurance Sector retirees can also hope.

However LIC retirees associations must keep in mind the recent letter 20.10.2020 of Labour minister to 65 lakh pensioners on revision of pension .

Respected Sri G. Krishnaswamy ji , LIC had continued Group Insurance Scheme for employees who have retired on or after 31/03/2018 & now more than than 1 year 4 moths and 22 days have passed from date of CO Circular of 5/1/2019 which implemented it. In between, AIRiEF could send only 2/3 letters & held dialogue with LIC Management to implement this scheme for all retirees up-to age 75 years . We had raised this matter from RIEA Jaipur long back in 2016-17. Now we feel that AIRIEF has forgotten to remind chairman it, in this grievance letter . Please make affected members ,clear the current stand of AIRIEF on this issue , What happened to our decision taken on 7/8 Nov, 2019 A Trichy OB/EC meet, to purchase a GI Master policy from P&GS , if chairmany doesn't agree to our demand. We pensioner members feel ignored not only by LIC Managing but also by leadership of AIRIEF, on this matter. We once again request you to kindly handle this issue for an outcome in favour of retirees, We wish that our worthy President , Sri S.S. Saxena ji will guide all concerned team members of AIRIEF & ensure to get implemented the GI , as per Existing Scheme of GI policy for ALL Retirees up-to age 75 or alternately, AIRIEFshould go for purchase of "A Group Insurance policy" soon looking to , Corona pandemic which has sent an ALARM of added risk on Pensioners' life. Dear friends,

You must have read the judgment in the case of All Manipur Retired employees case. This judgment fully supports my case. My case is the same except the difference of name of the parties and the date. This has ruled that whenever pay scales are revised the benefit of the same will have to be given to the retired employees and their pensions will be revised accordingly. This is my case since 2007 and Rajasthan High Court thrice and Punjab & Haryana High Court has ruled in the same manner. The rulings cited in this case were also cited by me besides several other rulings in our favour.

The second ruling is that the cost does not matter for the revision of pensions. I have also been vehemently opposing this plea of costs by giving the several data about the cost and expense ratio. But somehow these points have never been adverted to.

Now that the Manipur judgment has come to support us our case has got further strength.

I have today moved an application for early listing of my SLP debagging the same, as prayed earlier because my caste is separate, I have won it in two High Courts four times and once in the Supreme Court also while the cases of other Associations are fresh one and based on inconceivable grounds. Let us wait and see the fate of this application.

I am reading messages again and again about para 3A and 3B of Appendix IV. In my humble opinion this is the correct addition and I have also opposed the examination of the constitutionality of these Paras. Since on pension as applicable from 1/8/1998 the rate of DA on pay was 23 percent per slab so the same rate has been applied to pensions, since the pension is 50% of the basic pay the same rate is applicable therefore, the same will be applicable to the basic pension and that will equal the same rate as is applicable to pension. Since pension is 50 % therefore if the same rate is applied it will amount to 50% per cen

Para 3B has been inserted to avoid issue of Notification every time when the pay scales are revised.

I have been seeing the confusion being created that in the DA writ I was the single petitioner, but the effect is not being portrayed. In the writ petition of one petition the benefit whatever was given has been given to more than 3000 pensioners. The Constitution in Article 141 provides that the law enunciated by the Supreme Court is the law of the land and is binding on every court also. Therefore, LIC had to follow the same. In the case of LIC also decided in the year 2008 the SC has ruled that the judgment will be applicable to all LIC employees whether they are before the Court or not.

In this writ petition it was challenged that the slabs of DR have been so framed that 50% of the DA rate was made applicable to pension and the judgment though is the only cause for contention before the Courts but the effect of that is that the Board had passed resolution to correct the same and that the same rate of DR has been applied to pension as may be applicable from time to time.



The Delhi HC in its judgment has misapplied the rate of 0.23 per cent per slab on the pensions of pre-1997 without upgrading the pensions of those retirees of pre-1/8/1997, that is under challenge.



In the present writ petition of 2007 there were 26 petitioners myself being the first Petitioner. By virtue of Article 141 of the Constitution whatever will be the judgment that will be applicable to all pensioners of LIC.



By way of memory there is another instance of the year 2006 when I had filed a writ petition for grant of Gold Coin, as a result of that all the Pensioners throughout LIC were paid Rs. 3,000/- irrespective of the fact that I alone was the petitioner therein. Therefore, get rid of this confusion and misunderstanding being created, if any benefit is given that will be given to one and all pensioners.



The litigation has been extended because of some misunderstandings, otherwise if we had challenged the judgment of 31/3/2016 by review petition, most likely the litigation would have come to end.



I have been permitted by the HonтАЩble SC to argue my case myself. This permission had to be sought because of paucity of funds and the various Associations filing their fresh writ petitions in the year 1996 without taking into consideration that if the judgment is enforced it will be from the date of filing of the writ petition i.e. 2007 in my case and 2016 in other cases.



RIEA has been supporting me by meeting some expenditure but since their sources are limited it is becoming a burden on them even to bear the journey and stay expenses. So far I have been bearing all the other expenses of preparing the pleadings, arguments etc. and copies thereof besides searching law in our favour, while it is expected that if the dates are fixed more than the requisite number than their funds will also exhaust and it will become difficult to continue the litigation howsoever strong it may be. Therefore, I appeal to all the pensioners and even those who have retired before 1/8/2017 to make their contributions. Their contribution may be remitted to Retired Insurance EmployeesтАЩ Association, Jaipur in their account. This appeal has become essential because AIRIEF has stopped their assistance in the conduct of the case naturally after they have filed their separate writ before the Delhi High Court for obvious reasons irrespective of the fact that an application had been made to implead AIRIEF as a party Respondent in the SLP of 2013. I do not want to challenge the same.



If any contribution is made that may be made in the name of RIEA Jaipur which will help in continuing the case otherwise I am afraid when the money is finished, the case may also come to end. Those pensioners who have received the money as a result of this litigation in my case should be benevolent to contribute some money out of the same.
