सूरत के पांडेसरा इलाके में कुछ क्लीनिक बाहर से सामान्य तरीके से चल रहे थे। मरीज वहां पहुंचते, इलाज कराते और दवाइयां लेकर वापस चले जाते। लेकिन पुलिस को शक था कि इन क्लीनिकों में मरीजों का इलाज करने वाले लोगों के पास डॉक्टर बनने की जरूरी मेडिकल डिग्री नहीं है।

मामले की जांच के दौरान पुलिस ने डमी मरीजों को इन क्लीनिकों में भेजा। जांच में संदिग्ध गतिविधियों की पुष्टि होने के बाद पुलिस और स्वास्थ्य विभाग की टीम ने संयुक्त कार्रवाई की।

पुलिस और स्वास्थ्य विभाग ने पांडेसरा इलाके के 8 अलग-अलग क्लीनिकों पर छापेमारी की। पुलिस के मुताबिक, कार्रवाई के दौरान 8 लोगों को गिरफ्तार किया गया, जो कथित तौर पर बिना मेडिकल डिग्री के मरीजों का इलाज कर रहे थे।

पुलिस के अनुसार, गिरफ्तार आरोपियों की शैक्षणिक योग्यता भी अलग-अलग थी। इनमें कुछ लोग 12वीं तक पढ़े थे, जबकि कुछ ने बीएससी की पढ़ाई की थी। कुछ आरोपी पहले कंपाउंडर या ऑपरेशन थिएटर असिस्टेंट के तौर पर काम कर चुके थे।

जांच में यह भी सामने आने की बात कही गई है कि इनमें से कुछ लोग लंबे समय से मरीजों का इलाज कर रहे थे। पुलिस के मुताबिक, कुछ आरोपी करीब 10 साल से इस तरह का काम कर रहे थे।

फिलहाल पुलिस मामले की आगे जांच कर रही है और यह पता लगाने की कोशिश की जा रही है कि इन लोगों ने कितने समय से क्लीनिक चला रखे थे और कितने मरीजों का इलाज किया था।

This recent news has caused a stir in the medical fraternity, but the reports are largely misconceived. The Supreme Court's order is not a final ruling on whether doctors fall under the Consumer Protection Act (CPA).Here is what actually happened:

Technical Rejection : The order mentioned in the news relates to a Curative Petition filed by the Medico-Legal Society of India. The Constitution Bench dismissed it purely on a technicality, not on its actual merits.

The Court's Logic: The Bench clarified that a previous Supreme Court judgment cannot be challenged through a Curative Petition unless there was a glaring jurisdictional error in the prior review petition.
No Final Verdict: This ruling simply upholds that procedural boundary—nothing more, nothing less. It is not a definitive verdict from the Constitution Bench regarding the exclusion of doctors from the CPA.
What this means moving forward :This outcome does not affect the standing of the Association of Healthcare Providers India (AHPI) petition, which is currently pending before the Chief Justice of India. Despite how this seemingly adverse order looks on the surface, the legal status quo remains completely unchanged.
