Subject: The Promotion of the Cannabis Bill and the Ministry of Public Health’s Cannabis Control Measures
To: The Prime Minister
As the Ministry of Public Health has issued measures through ministerial regulations and announcements from the Department of Thai Traditional Medicine to control cannabis, the Cannabis Future Network believes that such measures cannot effectively protect consumers and instead benefit only a small group of people. Only those with money can comply with the criteria set under the definition of medical cannabis.
The mistake begins with the Ministry of Public Health’s approach in declaring cannabis as medical, but the measures requiring cannabis shops to be converted into medical facilities are rules that exclude the majority and favor a minority. At the same time, these measures push most cannabis users out of the system because they cannot afford to transform their shops into medical facilities. When the Ministry issues rules that exclude the majority, it effectively forces most people into illegality, assuming that enforcement and arrests will control them. This way of thinking does not align with reality and will lead to many more problems.
The correct approach is to issue measures that allow all groups to remain within the system. However, the measures issued by those in power at the Ministry require large sums of money to comply with the criteria for medical cannabis. Money thus becomes the deciding factor in whether cannabis can be considered medical. Furthermore, the measures are ineffective in protecting consumers: medical certificates can be bought and sold, and cultivation licenses can be transferred unlawfully. Consumer protection measures are therefore ineffective.
We therefore respectfully request the Prime Minister to instruct the Minister of Public Health as follows:
1. Ministerial regulations and announcements must be changed so that they do not exclude the majority or benefit only a minority. The measures must genuinely protect consumers. Current measures facilitate wrongdoing, such as the buying and selling of medical certificates, the trading of cultivation licenses, and the requirement to convert cannabis shops into medical facilities, which does not make cannabis medical simply by changing the building’s appearance.
2. The Prime Minister should sincerely and urgently push forward the Cannabis Bill through the legislative process to establish a comprehensive law governing cannabis control in Thailand.

เรื่อง การผลักดัน พ.ร.บ.กัญชาและมาตรการควบคุมกัญชาของกระทรวงสาธารณสุข
กราบเรียน นายกรัฐมนตรี
ตามที่กระทรวงสาธารณสุขได้ออกมาตรการโดยกฎกระทรวงและประกาศกกรมการแพทย์แผนไทยเพื่อควบคุมกัญชานั้น เครือข่ายเขียนอนาคตกัญชาไทยมีความเห็นว่ามาตรการดังกล่าวเป็นมาตรการที่ไม่อาจคุ้มครองผู้บริโภคอย่างมีประสิทธิภาพและเป็นมาตรการที่เอื้อประโยชน์แก่บุคคลกลุ่มเดียว ผู้ที่มีเงินเท่านั้นจึงสามารถทำตามหลักเกณฑ์ที่กำหนดของนิยามกัญชาทางการแพทย์
ความผิดพลาดเริ่มจากวีธีคิดของกระทรวงสาธารณสุขในการประกาศกัญชาทางการแพทย์แต่มาตรการที่กำหนดการเปลี่ยนร้านกัญชาจากเดิมเป็นสถานพยาบาลเป็นกติกาที่กีดกันคนส่วนใหญ่และเอื้อประโยชน์แก่คนบางกลุ่มแต่ในขณะเดียวกันมาตรการเหล่านั้นผลักคนกัญชาส่วนใหญ่ออกจากระบบเพราะไม่มีเงินพอในการทำร้านให้เป็นสถานพยาบาล เมื่อกระทรวงสาธารณสุขออกกติกามากีดกันคนส่วนใหญ่ให้อยู่นอกระบบ เท่ากับผลักคนส่วนใหญ่ให้ทำผิด โดยกระทรวงคิดว่าจะใช้มาตรการจับกุมเพื่อควบคุมคนส่วนใหญ่ให้ได้ ภายใต้วิธีคิดที่ไม่สอดคล้องกับบริบทของความจริงปัญหาจะตามมาอีกมากมาย
วิธีคิดที่ถูกต้องคือจะต้องออกมาตรการที่จะทำให้ทุกกลุ่มอยู่ในระบบได้ แต่มาตรการที่ออกโดยผู้มีอำนาจในกระทรวงคือ กำหนดมาตรการที่ต้องใช้เงินจำนวนมากจึงจะทำตามหลักเกณฑ์เพื่อให้กลายเป็นกัญชาทางการแพทย์ได้ เงินจึงกลายเป็นปัจจัยชี้วัดว่ากัญชาจะกลายเป็นการแพทย์ได้หรือไม่ นอกจากนี้ยังพบว่ามาตรการที่ออกมาไร้ประสิทธิภาพในการคุ้มครองผู้บริโภค ใบแพทย์สามารถซื้อขายกันได้ รวมทั้งใบมาตรฐานการปลูกก็ใช้วิธีการสวมสิทธิ์ มาตรการคุ้มครองผู้บริโภคที่จึงไร้ประสิทธิภาพ
จึงขอให้เรียกร้องต่อนายกรัฐมนตรีสั่งการไปยังรัฐมนตรีว่าการกระทรวงสาธารณสุขดังนี้
1.กฎกระทรวงและประกาศกระทรวงจะต้องเปลี่ยนแปลงไม่ออกมาตรการกีดกันคนส่วนใหญ่เอื้อประโยชน์คนส่วนน้อยรวมทั้งมาตรการนั้นต้องคุ้มครองผู้บริโภคได้จริง ทั้งนี้มาตรการที่กระทรวงสาธารณสุขออกมานั้นเอื้อให้เกิดการกระทำผิดได้ง่าย เช่นการซื้อขายใบแพทย์ การซื้อขายใบมาตรฐานการปลูก และการเปลี่ยนรูปร่างของร้านจากร้านขายกัญชาเดิมเป็นสถานพยาบาลไม่ได้ทำให้กัญชากลายเป็นการแพทย์ด้วยการเปลี่ยนรูปร่างของอาคารสถานที่
2.ขอให้นายกรัฐมนตรีมีความจริงใจเร่งผลักดัน พ.ร.บ.กัญชาตามขั้นตอนอย่างรวดเร็วเพื่อให้เกิดกฎหมายแม่บทว่าด้วยการควบคุมกัญชาเชิงระบบในประเทศไทย
