Maybe we had time to prepare, or maybe we have been blindsided with the unimaginable. Either way, there are important steps that we should never navigate alone. 🫂

🏠 If the death occurred at home unexpectedly:
Call 911. They will guide next steps and contact the medical examiner or justice of the peace if required.
🏥 If the death occurred at a hospital or care facility:
Staff will pronounce the death and begin paperwork. The facility may hold your loved one until you've chosen a funeral home.
👩‍⚕️If the death occurred under hospice care:
Call your hospice nurse. They will come to pronounce the death and handle initial documentation. They will also reach out to your funeral home provider.

Whether our family believes in traditional services or simple and straightforward arrangements, our loved one can be celebrated in a way unique and specific to their wishes. ✨ Prior to our cremation we can host a visitation and celebration at your place of worship, or services can be simple and straightforward.

It's not always intuitive and clear-cut...So who does have the right and responsible to make decisions about our loved one's funeral arrangements? 🤔

⚖️ Texas Health and Safety Code §711.002
establishes the legal order of authority:
1. Person designated in a written
instrument by the deceased
2. Surviving spouse
3. Any surviving adult children
(majority required for cremation)
4. Either surviving parent
5. Any adult sibling
6. Next degree of kinship

You also have the right to decline to make decisions and pass responsibility to the next surviving loved one.

Important: The person who can pay is not always the person with legal authority. The funeral home must follow this legal order regardless of who is offering to pay.
