Final Reminder

Listen up business owners. If you were in business during the Coronavirus Pandemic and you had 10 or more w2 employees, please schedule a free assessment with an experienced tax firm to see if your business qualifies for the employee retention tax credit refund.

The hard deadline to file for this tax credit refund is July 10, 2026.

Two federal courts (Kwong v. United States and Abdo v. Commissioner) recently ruled that COVID-era IRS penalties and interest were unlawfully assessed. That means refunds may be available to a wide range of U.S. taxpayers.

Additionally, the Employee Retention Credit (ERC) window may still be open — worth up to $19,000 per employee for businesses that:

Were fully or partially shut down by a COVID government order,

OR

Saw a significant revenue drop vs. 2019 (50%+ in 2020, 20%+ in 2021)

Unfortunately, in the past, many business owners were told the ERC deadline had passed. Based on the court rulings, that may no longer be accurate.

The IRS has appealed these decisions, which is exactly why protective claims need to be filed before July 10, 2026.

The 2024 Louisiana Ambulatory Surgery Center Association Annual Meeting was a great success. More than 50 Ambulatory Surgery Centers participated in the February 23rd Annual Meeting held at the West Baton Rouge Conference Center.

LASCA Annual Meeting scheduled for Friday February 23, 2024

Today, the American Association of Peri-Operative Nurses notified us that AORN approved our 2024 LASCA Annual Meeting for 5.5 CEU's! Additionally, our LASCA annual meeting has been approved for 5.5 hours by CASC.

We are excited about our 2024 Annual Meeting scheduled for February 23rd at the West Baton Rouge Conference Center. This will be a hybrid meeting, meaning you can participate onsite or through our virtual ZOOM Platform. We have a great speaker line-up and will have a robust trade show with exhibitors showcasing the latest products and services for ASCs.

Employee Retention Payroll Tax Credits

Does your ASC Qualify?

The Louisiana Ambulatory Surgery Center Association has partnered with ERC Specialists to help our members determine their eligibility for a refundable payroll tax credit for W2 employees. In the past, employers could only apply for the Payroll Protect Plan or the Employee Retention Payroll Tax credit but that has changed and now employers can apply for both. Congress changed this policy last year with the passage of the American Rescue Plan signed into law by President Biden in March of 2021.

There are three different ways to demonstrate that your ASC is qualified:

1) revenue loss due to the Coronavirus Pandemic or

2) supply chain issues related to the Coronavirus Pandemic or

3) Suspensions related to the Coronavirus Pandemic

Since Louisiana physicians could not perform elective medical procedures for a period of time during the pandemic, it is not difficult for an ASC to demonstrate a 10% suspension.

If your ASC is deemed to be eligible, ERC Specialists will help you to apply for the payroll tax credit. You may be eligible to receive the maximum of $26,000 per W2 employee for 2020 and 2021.
