ECAPS is on the move: Update and next steps from APhA



Today marks a historic milestone in our fight to expand patient access to pharmacist-provided care nationwide.

The U.S. House Ways and Means Committee has advanced the Ensuring Community Access to Pharmacist Services Act (ECAPS), now known as the Main Street Pharmacy Access Act (H.R. 3164/S. 2426).

This is the furthest legislation paying pharmacists under Medicare Part B has advanced in Congress—and it would not have happened without your advocacy, your outreach, and your voice.

We need your help now more than ever to bring the Main Street Pharmacy Access Act across the finish line before the end of the year!

Please contact your Members of Congress by going to APhA’s easy-to-use Advocacy Center and urge them to support this legislation. Your voice as a pharmacist is powerful, and lawmakers need to hear directly from you about how this bill will expand access to care and strengthen community pharmacy.

What still needs to happen

While today’s advancement is a major victory, several important steps remain before this legislation can become law:

Consideration by the House Energy and Commerce Committee
Passage by the full House of Representatives
Consideration and passage in the U.S. Senate
Reconciliation (if needed) and final enactment

Every one of these steps will require continued advocacy from engaged pharmacists and supporters like you who are dedicated to ensuring patients, especially those in rural and underserved communities, receive the timely care they deserve.

Massachusetts House Bills H.4493 and H.1234 represent significant legislative efforts to reform Pharmacy Benefit Managers (PBMs) by increasing transparency, regulating reimbursement rates, and prohibiting "steering" practices that favor PBM-owned pharmacies. These bills aim to protect independent pharmacies and reduce prescription drug costs for consumers.
Key Provisions of MA PBM Reform (H.4493)
Anti-Steering Measures: PBMs are prohibited from steering patients toward pharmacies they own or operate.
Fair Reimbursement Rates: Payments to non-affiliated pharmacies must be equal to or greater than those paid to pharmacies affiliated with the PBM.
Ban on Retroactive Discounts: The legislation prohibits the use of "clawbacks" and retroactive discounts, which can make it hard for smaller pharmacies to remain profitable.
Pharmacy Access: PBMs must allow any licensed Massachusetts pharmacy to participate in their networks, including for specialty drugs, provided they meet the same service requirements.
