Birthright citizenship remains protected after the Supreme Court ruled against Trump’s effort to limit citizenship for children born in the United States to undocumented or temporary immigrant parents. For many, the decision brought relief because it kept the 14th Amendment’s citizenship promise in place.

Still, the ruling also raised concern because of how close the constitutional fight became. Five justices backed the broader 14th Amendment reading, while four did not fully accept that view. Justice Ketanji Brown Jackson used her concurrence to push back against Justice Clarence Thomas, arguing that his reading wrongly turned Black history against immigrant families.

Jackson wrote that freed Black Americans were not fighting for a narrow freedom that applied only to them. They were pushing for a wider promise of citizenship, dignity, and equality that could protect everyone born under American law.

Her opinion framed birthright citizenship as part of the country’s unfinished fight against caste, exclusion, and racial subordination. To Jackson, attempts to pit Black Americans against immigrants distort the history of Reconstruction and weaken the very freedom Black people fought to secure.

Reaction to the ruling has been intense, with supporters calling it a major defense of constitutional equality and critics arguing citizenship rules should be narrowed. At the center of the debate is a deeper question: who gets to belong in America, and how far will the country go to protect that promise?
