One of the hardest parts of my job is informing my clients of the need to amend their disability date. Many times I believe they have been disabled for much longer than we can show through the evidence. Your medical evidence is critical in both establishing the impairments and in establishing your date of disability.

Teachers, Clergy and Laborers. If you work for cash and/or elect not to pay some taxes, you will likely not qualify for disability benefits. Also, if your employer does not hold out taxes on your check you will likely not have the required credits to qualify for disability benefits unless you elect to pay those. 🙈

So, …..many clients want to know how long the disability process takes. There is no good answer to that question. Many factors like age, work history, education, and available evidence all play a role. Drug and alcohol use, incarceration, and even assets can be factors as well. Sometimes it depends on the reviewing doctor and how they see your case. Some cases are resolved in a few months and some take years.

I get many questions from clients about working and disability. Most of the time the answer is it depends on several factors. If a person is working and demonstrates substantial gainful activity, that person usually is not eligible to receive benefits.

I often hear people tell me that there are no jobs where they live. Disability is not dependent on jobs in your area. Keep in mind …Disability is determined by the ability to perform work, and is not dependent on job openings in your town.
