If you live in Wisconsin and have questions about paternity, the state's marital presumption is the first thing to understand. Under Wisconsin law, a husband is automatically presumed to be the father of any child born during the marriage.
For unmarried parents, the state allows voluntary acknowledgment of paternity — either at the hospital or later through the Office of Vital Records. Either parent can rescind within 60 days.
When paternity is disputed, courts can order DNA testing. A result showing 99.0% or higher probability creates a legal presumption.
