Afraid bankruptcy means losing your home? That fear is keeping good people stuck.

Here's the truth: most of what you've heard about bankruptcy simply isn't true. And believing the myths could cost you the fresh start you deserve.

Let's set a few things straight:
- "I'll lose everything I own." In Kentucky, you can choose the state or federal exemption list β€” whichever protects more of your property. Most Chapter 7 filers keep their home, car, and belongings.
- "My credit is ruined forever." Many people start rebuilding within a year because the debt dragging them down is finally gone.
- "Everyone will find out." No announcement goes out to your family, friends, or employer. Your business stays your business.
- "Chapter 13 means I lose my house." It's actually the opposite β€” a 3-to-5-year plan helps you catch up on missed mortgage or car payments while keeping the property.

You're not a failure for asking for help. Job loss, medical bills, and life's curveballs push honest, hardworking people into debt every day.

The right path depends on your situation β€” and that's exactly what we're here to walk through with you.

Scared to file for bankruptcy? You might be believing one of these myths.

Fear stops more people from getting help than money ever does. But a lot of what you "know" about bankruptcy simply isn't true.

A few of the big ones we hear every week:
- "I'll never get credit again." (Most people rebuild faster than they expect.)
- "Everyone will find out." (Your business stays your business.)
- "I'll lose everything I own." (Exemptions protect far more than you'd think.)

The truth might surprise you β€” and it could change how you see your options.

We break down all 5 myths in our latest blog. Read the full post to get the facts before fear makes the decision for you. πŸ”— https://www.thatlawlady.com/5-common-myths-about-bankruptcy/

Creditors have rules they have to follow. Do you know what they are?

The Fair Debt Collection Practices Act (FDCPA) sets clear limits on how debt collectors can treat you. Knowing these limits helps you spot the difference between a legal reminder and outright harassment.

Here's what collectors cannot legally do:
- Call at all hours. They can't contact you before 8 a.m. or after 9 p.m. without your okay.
- Harass or threaten you. No repeated calls to annoy you, no abusive language, and no threats of arrest or violence.
- Lie or deceive you. They can't pretend to be attorneys or law enforcement, or misstate how much you owe.
- Contact you at work once they know your employer doesn't allow it.
- Talk to others about your debt. They can reach out to people to find you, but they can't share the details of what you owe.

You also have the right to tell a collector to stop contacting you in writing. Once they get that letter, most contact has to stop.

The takeaway: if a collector is threatening, calling nonstop, or twisting the truth, that's not just rude β€” it may be illegal. Recognizing it is the first step to protecting yourself.

Chapter 7 or Chapter 11 β€” which one is actually right for you?

Both offer a path out of overwhelming debt, but they work in very different ways. Here's a breakdown to help you start thinking about your own situation.

Chapter 7 β€” the fresh start

Who it fits: You'll need to pass a Means Test, which looks at your income. It's usually built for lower-income individuals who can't realistically catch up on what they owe.
What it clears: Most unsecured debt, like credit cards, medical bills, and some personal loans.

The trade-offs: It's fast, often wrapping up in a few months. It's technically a "liquidation" filing, but many people keep all their property because state and federal exemption laws often protect it. A trustee can still sell non-exempt, high-value assets to pay creditors. It also stays on your credit report for 10 years.

Chapter 11 β€” the reorganization plan

Who it fits: Primarily used by businesses, but individuals with very high debt loads that exceed Chapter 13 limits can file too. It works best when there's ongoing income and a reason to keep operating or restructuring.

What it addresses: Allows you to propose a reorganization plan to restructure what you owe β€” often renegotiating debt terms with creditors rather than wiping them out entirely.

The trade-offs: It's complex, costly, and can take years to complete. Legal and administrative fees are significant. However, it can be a powerful tool for those who need flexibility that other chapters don't offer.

Quick check: Is your income low and your debt mostly unsecured? Chapter 7 may fit. Are you a business owner or carrying very high debt with ongoing income and assets worth protecting? Chapter 11 might be worth exploring.

Still not sure? That's exactly what we're here for.

Your paycheck shouldn't shrink before it even hits your account.

But that's exactly what wage garnishment does. A creditor gets a court order, and part of your pay is pulled straight from your check before you ever see it. For a lot of families, that missing chunk is the difference between covering rent and falling further behind.

Here's what many people don't know: you can stop it.

The moment you file for bankruptcy, something called the automatic stay kicks in. It legally pauses most garnishments right away, meaning your next paycheck can land in your account whole again.

You don't have to wait and watch your income disappear week after week. Acting early puts you back in control faster than most people expect.

Is your paycheck being garnished? Call 502.583.8300 today.
