Just had a consult with a parent and going over some things I realize my parents need another reminder; an IEP IS A LEGALLY BINDING DOCUMENT! If the school is not enforcing an IEP here are the steps prior to your right to FILE A LAWSUIT AGAINST THE SCHOOL! you are the expert of your child! I dont care what degrees they have do not let others dictate the care of your children without your input and direction!
1st Document specific concerns (missed services, accommodations, dates, and communication).
2nd Talk with the teacher and case manager to address concerns and seek clarification.
3rd Request an IEP meeting to review implementation and discuss solutions.
Contact the Special Education Director if concerns are not resolved at the school level.
4th Request Prior Written Notice (PWN) for any refusals or changes to services.
Use informal dispute resolution options such as facilitated meetings or parent liaison support.
5th File a state complaint if the district is not complying with the IEP.
6th Request mediation to work with the district and a neutral mediator toward a resolution.
7th File for due process to pursue a formal hearing regarding the dispute.
8th Consider legal action if other remedies have been exhausted and the issue remains unresolved.
