DOT’s updated Part 40 rule is now in effect.

The rule requires a directly observed urine collection in certain situations where oral fluid testing would otherwise be required but cannot currently be conducted because it is not yet available. DOT’s final rule was published in the Federal Register and became effective June 10, 2026.

That means employers should not wait until a collection issue happens to find out their process is outdated.

Now is the time to review:
- DER standing orders
- Collection-site instructions
- Internal SOPs
- Staff training
- Client communications
- Documentation workflows
