On May 21, 2024, the American Law Institute changed the standard of care framework forever.
As a dual-qualified physician-attorney (DO, JD), I have seen firsthand how standard of care opinions shape the outcome of medical malpractice cases. When I analyze cases, I draw not only on my medical expertise but also my understanding of current legal frameworks that impact both patients and attorneys.
Standard of care analysis relies on comprehensive case reviews, analyzing medical records and offering expert opinions on causation, standard of care, and prognosis. My consulting services are all about delivering unbiased opinions based on medical facts and evidence, ensuring every determination is grounded in objectivity.
It is important to recognize that guidelines like clinical practice guidelines are useful as reference points. However, they are not definitive benchmarks for the legal standard of care—each guideline’s credibility and reliability must be carefully assessed in the context of the case. In fact, on May 21, 2024, the American Law Institute introduced its first restatement of the law of medical malpractice, adding fresh perspectives and new standards for resolving malpractice claims.
