If you're divorcing a business owner, be careful not to let frustration turn into a costly mistake.

I'm currently handling two cases where one spouse attempted to take control of the business during the divorce. Employees were disrupted, business property was taken, and the business itself suffered.

If the business has community value, harming that business can hurt both spouses and may expose you to sanctions or other legal consequences.

What should you wear to court, mediation or arbitration?

It isn't about expensive clothing. It's about showing respect for the process and making the best possible first impression.

Over the years I've seen clients arrive dressed appropriately... and I've seen others show up in outfits that distracted everyone in the courtroom for all the wrong reasons.

Can a husband receive spousal support in California?

Yes.

California courts don't award spousal support based on gender. They consider each spouse's income, earning ability, health, disability, and many other factors.

In today's video, I answer a question from a stay-at-home husband who became disabled after losing part of his leg. He wanted to know whether he could receive spousal support and whether he could remain in the family home during the divorce.

Every case is different, but don't assume you have no rights simply because you're the husband.

Who gets the dog?

It's one of the most emotional questions many couples face during a divorce.

Can your spouse use money to keep you trapped in the marital home?

One spouse earns substantially more and pays most of the household bills. The other spouse cannot afford to move out without child and spousal support. But the higher-earning spouse refuses to provide any support until a judge officially orders it.

So, is the lower-earning spouse stuck?

Not necessarily.

In California family court, we have successfully approached this situation by presenting the judge with a concrete move-out plan, including:

The proposed rental home
The monthly rent
The security deposit
The intended move-in date
Reasonable moving expenses
Utility deposits and startup costs
The anticipated post-move budget
The proposed parenting schedule

The court may consider ordering an initial amount to make the move possible and then setting a return hearing shortly after the move to evaluate ongoing child and spousal support.

The judge will also consider that the higher-earning spouse is currently paying most of the household expenses. That means the result is not automatic and will depend on the specific facts, the parties’ incomes, the children’s needs, and the proposed living arrangements.

But one spouse should not assume that controlling the money gives them the power to prevent the other spouse from leaving.

Will your divorce ever settle?

One of the biggest fears people have is that their spouse will never agree to mediation or settlement.

Today I watched a case where that seemed exactly true.

The parties came to court to deal with immediate issues. Once those issues were resolved, they were able to negotiate outside the courtroom and begin settling the case.

Sometimes people need to see what litigation really looks like before they become willing to compromise.

That is why I always tell clients not to lose hope. Mediation often succeeds because the timing is finally right.

Six years together. Children. A home and an entire life built as a family.

Does California treat you as married?

Generally, no.

California does not recognize a common-law marriage created merely because two people lived together—even when they raised children and presented themselves as a family.

If unmarried parents separate, they will generally have a parentage case addressing custody, parenting time and child support. They do not ordinarily have a divorce case, spousal support rights or automatic community-property claims to assets accumulated in the other partner’s name.

That can include retirement benefits accumulated while the couple was living together but not married.

There are limited circumstances in which an unmarried partner may pursue claims based on an agreement between the parties, sometimes referred to as Marvin claims. Those claims are uncommon and are very different from the protections provided by California’s marital-property laws.

The difficult reality is that you can build an entire family together and still lack the legal rights of a spouse.

Who really has the final vote in your divorce settlement?

It may not be you.

Professional mediators have a saying: "Make sure you have all the witches at the table."

That doesn't mean your new partner should attend the mediation. In most cases, they shouldn't.

It means that if you're going to go home, discuss the proposed settlement with your new boyfriend or girlfriend, and their opinion could change your mind, then they have what I call a **quiet vote**.

One conversation after mediation can undo hours of successful negotiations.

That's why experienced mediators work to identify the people who have a quiet vote before everyone believes there's a final agreement.
