ADDRESSING THE FACTS ON NON-INTOXICATING CBD
One of the most consistent arguments made by advocates of a h**p ban is that under the ban, non-intoxicating CBD products would still be available to consumers. A recent joint letter from 35 state attorneys general says that the ban would preserve “access to safe, nonintoxicating h**p products."

THIS IS MANIFESTLY NOT TRUE. Under the proposed ban, the vast majority of h**p-derived CBD products with greater then 0.4
mg THC per container would be deemed Schedule 1 narcotics – akin to he**in and fentanyl. The vast majority of CBD products use a modest amount of THC in their formulations.

A study by Johns Hopkins has shown the intoxicating threshold for CBD products is 3.7 milligrams of THC per serving, nearly 10 times the limit per container as defined in the h**p ban. Most CBD products have 30 servings per container. Seniors and veterans would commit a federal crime by accessing these products that benefit their health and wellness.

Whitney Economics estimates that under the ban, only 5% of h**p products would remain legal. The remainder of non-intoxicating CBD products – which Whitney Economics comprises a $8.9 to
$12.7 billion market – would be banned in November, unless Congress passes an extension. Nearly one in 5 American adults used CBD in the preceding year. As of 2022, there were 4384 CBD
products offered by 188 brands.

The h**p ban would also make the President’s new CMS pilot program for seniors unworkable. Full spectrum CBD products that presently could be used under the program – which allows up to 3 mg per serving - would be federally illegal. Only CBD isolates could be utilized, a niche product that most Americans do not find helpful.
