The recognition of Customary Marriages in South Africa

The Recognition of Customary Marriages Act 120 of 1998 specifies the requirements of a legal customary marriage, if amoungst other things, the marriage is concluded according to the customs traditionally observed among the indigenous people, and which form part of the(ir) culture.

According to Section 4(3)(b) of the RCM, customary marriages must be registered, within three months of taking place, however, non-registration does not invalidate the marriage.
