In order to carry out a testamentary capacity assessment I require the following information :
- Testamentary intentions
- Full details of assets including those held abroad
- Full names of all beneficiaries and their relationships to the testator (person making the will)
- Details of anyone being excluded from the will who is likely to challenge the will later and reason/s for their exclusion
- Changes / reasons for making a new will
- Medical history with list of current prescribed medications
Wills involving large estates and those considered "controversial" are more likely to be contested after death. Having a robust capacity assessment undertaken by a medical doctor with court compliant report reduces the potential of a successful challenge.
