After a rideshare accident, you might hear from three or four different insurance companies.

Your personal insurer. The rideshare driver's personal insurer. The rideshare company's commercial carrier. And possibly the other driver's insurance if they were at fault.

Each one will try to shift responsibility to the others. Each one will ask you questions, hoping you will say something that helps their position.

This is exactly why many rideshare accident victims benefit from talking to an attorney before giving recorded statements.

The insurance maze is designed to confuse you.

Rideshare accident victims often notice something frustrating.

The day of the crash, you exchanged information, filed the report in the app, and felt shaken but physically okay.

Then you woke up the next morning with neck pain, headaches, and back stiffness that was not there before.

This is completely normal. Adrenaline and stress hormones mask pain signals.

Soft tissue inflammation takes time to develop.

Keep a daily journal of your symptoms starting immediately after the accident.

This documentation helps both your medical treatment and any insurance claim.

Rideshare drivers are often shocked when they learn about the deductible.
Uber and Lyft collision coverage comes with a deductible around 2,500 dollars.

And it only applies if you already have collision on your personal policy.

Many drivers assume the rideshare company will cover their car repairs like regular insurance.

Then they crash, file a claim, and discover they owe 2,500 dollars out of pocket, possibly more if their personal insurer denies the claim for commercial use.

If you drive for Uber or Lyft and have been injured in a crash, we can help with your medical care as you navigate the insurance maze. Call 602-632-0000.

What happens if an Uber or Lyft driver hits your car?

It depends entirely on what the driver was doing at that moment.

If they were actively on a trip or en route to pick someone up, you can likely claim against the rideshare company's commercial policy.

If they were just driving around with the app on, coverage is more limited.

If the app was off, it is just a regular accident claim against their personal insurance.

Proving which phase they were in requires their cooperation or legal discovery.

Document everything and consider consulting an attorney.

Uber and Lyft drivers have three different insurance situations, and the gaps between them catch many people off guard.

When the app is off, only personal insurance applies.

When the app is on but waiting for a ride, the rideshare company provides limited coverage.

When driving to pick up or with a passenger, fuller commercial coverage kicks in.

The problem is that many personal auto policies exclude coverage when you use your car for rideshare.

This creates moments where drivers may have much less protection than they realize.

If you are injured while riding in an Uber or Lyft, the insurance situation is more complicated than you might expect.

When your driver is at fault during an active trip, the rideshare company's insurance is typically the primary coverage.

They carry high liability limits specifically for this situation.

But if another driver caused the crash, you may need to pursue their personal insurance first. The rideshare coverage might only step in under certain conditions.

The key is documentation. Take a screenshot of your trip details and driver info before you leave the scene. You will need proof you were an active passenger.

Every patient who has been hit by an uninsured driver tells me the same thing.
"I never thought it would happen to me."

Arizona has one of the highest rates of uninsured drivers in the country.

The math is not in your favor. Given enough time on the road, your chances of encountering an uninsured driver approach certainty.

The good news is you can protect yourself before it happens. UM and UIM coverage. Collision coverage.

These are not expenses. They are protection against someone else's irresponsibility.

Most people only think about UM and UIM coverage after they have been hit by an uninsured driver.
By then, it is too late.

Take 15 minutes this week to call your insurance agent. Ask what your current UM and UIM limits are.

If they are low or nonexistent, ask what it costs to increase them. In most cases, the cost is surprisingly reasonable for the protection you get.

If you have already been hit by an uninsured driver in Phoenix or Mesa, we can help with your injuries.

Same-day appointments, zero out-of-pocket cost, and we work with your insurance to maximize your coverage.

Here is something that surprises many Arizona drivers after being hit by an uninsured driver.

Arizona does not have uninsured motorist property damage coverage.

Your UM coverage only pays for injuries, not vehicle repairs.

If an uninsured driver totals your car, your options for fixing or replacing it depend entirely on whether you carry collision coverage on your own policy.

Many people assume their insurance will cover everything.

Then they discover their medical bills are covered under UM, but their destroyed car is not. Collision coverage is the only protection.

Uninsured motorist coverage and underinsured motorist coverage sound similar but work differently.

UM coverage kicks in when the driver who hit you has no insurance at all. It covers your medical bills, lost wages, and pain and suffering up to your policy limits.

UIM coverage helps when the other driver has insurance, but not enough to cover your injuries. Their policy pays first, then your UIM coverage adds to it up to your limits.

Arizona insurers must offer both, but you can decline in writing. If you declined, please reconsider after reading this.
