Join us to celebrate 25 years of Pregnancy Justice and recognize Lauren Smith, an advocate and mother of three from South Carolina, who courageously fought her case, refusing to back down.

“For more than six years, the state of South Carolina disrupted my life, making me live with the possibility of facing 10 years in prison and losing my kids for using THC to treat my morning sickness. When I was arrested, I didn’t feel like a mother or someone who just had a happy baby. I felt like a criminal for being in my own body.” - Lauren Smith.

Finally, in early April of this year, South Carolina fully dismissed her case. This is why our work matters. We admire Lauren’s resilience and are grateful for her willingness to speak out about the injustices she faced, which will help advance pregnant people’s rights. The mothers of Black newborns are reported to police for alleged substance use during pregnancy around 2.5 times more often than those of white babies. We know this worsens health outcomes for mother and infant, while Black women are already at a higher risk of death.

This is why informed consent before drug testing is so important. No one should be unnecessarily investigated, punished, and separated from their newborns by the family policing system.

Thanks to Act 292, “The Unborn Child Protection Act,” Wisconsin is one of the most punitive states in the country for pregnant people who test positive for substances. The 1998 law, deemed unconstitutional by Wisconsin’s Western District federal court, is one of many that grant a fetus greater constitutional protections than the person carrying it. Fetal personhood laws such as these are harmful for all pregnant people.

The administration is trying to quietly give legal rights to embryos and fetuses by possibly requiring child support at conception. We know if they actually wanted to make sure people were cared for during pregnancy, they would provide better prenatal health, medicaid expansion, and state and federal health programs. Treating embryos and fetuses like living people doesn’t help us. It can kill us. Don’t fall into their anti-abortion agenda.

But reproductive justice does not begin or end with Roe, and the criminalization of pregnancy is far from new.

We envision a world where pregnant people are treated with dignity and autonomy. Where their humanity is honored, and where we all have a right to have children, not have children, to parent children in safe communities, and to access vital medical care like contraception and abortion
