After five weeks of testimony and seven days of deliberation, the jury in Lindsay Clancy’s trial could not reach a unanimous verdict. Eleven jurors agreed; one man on the jury did not, and Clancy’s defense argued in an emergency appeal that this holdout juror was refusing to follow the judge’s instructions on reasonable doubt. That appeal failed, and the judge declared a mistrial on Friday. The judge has indicated he’d like to retry the case later this fall, so this isn’t over — it’s paused.

I wrote the essay below while the jury was still out, thinking about what a verdict either way would mean for how we understand postpartum psychosis. What happened instead is harder to sit with. Eleven people, nine of them women, apparently heard the same evidence and reached the same conclusion. One man did not, and by Clancy’s own defense’s account, did not get there by following the law he was instructed to follow. That’s not closure. That’s a woman still waiting, again, for a system that was already struggling to hold her illness to actually see it clearly.

Two hundred fifty years ago, a group of men signed their names to an idea: that a nation could be built, tested, and revised in real time. They called it an experiment because they didn’t know if it would work. They also didn’t ask half the population if they wanted in.

A month past the actual anniversary, this felt like the right moment to ask: how’s the experiment going for women, not the founding-myth version, the actual one. Wages, healthcare, representation, the quiet accumulation of laws and norms that shape whether a woman’s citizenship feels full or partial. That question matters a great deal right now, because the loudest thing said about American women this year has been about how many babies they should be having.

This season we’ve been awash in pronatalist messaging, encouraging women of America to have more babies. This seeming national priority has been taken up by the likes of influencer Erica Kirk, who told a graduating class to “have more babies than you can afford.” Dr. Oz says America is “underbabied.” Donald Trump has said he’ll be known as “the fertilization president.” JD Vance says he wants “more babies in the United States of America.” On its face, this looks like a nation that loves babies and supports women and families after birth. It couldn’t be further from the truth. Our national statistics around medical access, maternal mortality, paid family leave, and affordable childcare are abysmal. These messages could not be more tone-deaf for a nation ranked last in many categories of maternal health.

“Have more babies than you can afford” might as well be restated as:

“Tie cinder blocks to both of your ankles, and jump in a river.””Prepare yourself for a lifetime of worry and stress that will impact your health.””Give up all your personal dreams outside of having children.””Prepare yourself to be in this partnered relationship for the foreseeable future. There will be no easy way out.”
