As many of you are aware, APTA New York was successful during the 2025 legislative session in securing passage of legislation to remove the on-site supervision requirement for Physical Therapist Assistants (PTAs). This legislation was signed into law by Governor Hochul last November and will take effect next month on November 21, 2026.

Following the Governor’s signature last year, the Board of Regents proposed and adopted implementing regulations. These regulations were formally adopted last week by the Board of Regents, and also take effect on November 21, 2026.

This legislation and the implementing regulations represent an important advancement in how PTAs may be supervised in New York. As of November 21, 2026, supervision by a licensed physical therapist (PT) remains continuous, but it will no longer require the PT to be physically present at the same time and location where services are being provided. The PT must, however, be available for consultation with the PTA or the patient within a reasonable amount of time. The regulations specify that the supervising PT must be available for in-person or remote consultation with the PTA or patient in a timely manner, taking into consideration the practice setting, the condition of the patient, and the physical therapy services being provided. The regulations further specify that the supervising physical therapist must be accessible at least by telecommunication, and be able to respond appropriately to the needs of the PTA and patient. Finally, the regulations state that the supervising PT and their PTA should develop a predetermined plan for emergency situations, including the designation of an alternate licensed PT if the regular supervising PT is unavailable.

This change is important because modernizing supervision requirements can expand access to medically necessary physical therapy services without changing the scope of practice of the PTA or diminishing the PT's responsibility for the patient's plan of care. Ultimately, this legislation supports a more efficient and responsive model of physical therapy delivery while maintaining the essential safeguards of PT oversight. It strengthens our profession's ability to put the right provider in the right place at the right time, improve access to care, reduce unnecessary delays, and better meet the needs of the patients and communities we serve.
