Attorney General James Uthmeier announced a lawsuit alleging Prime Therapeutics and Express Scripts fixed prices that led pharmacies to lose money. The lawsuit alleges that Prime Therapeutics and Express Scripts formed an illegal horizontal price-fixing agreement in December 2019 to suppress pharmacy reimbursement rates.

This collusion, which began in April 2020, reportedly impacts 80 percent of branded and 70 percent of generic drugs, resulting in $2.5 billion in savings for Prime while forcing independent pharmacies to dispense medication at a loss. The lawsuit charges the companies with antitrust violations, unfair competition, and unjust enrichment.

The attorney general also launched a civil investigative demand to CVS Health in June.
